Officially Proposed for Priority Prolegnas, Government Invites the Public to Provide Input to the National Education System Draft Law

NEWS-The government has officially submitted the Draft Law on the National Education System/Rancangan Undang-Undang tentang Sistem Pendidikan Nasional (RUU Sisdiknas) in the National Legislation Program/Program Legislasi Nasional (Prolegnas) Priority Changes for 2022 to the House of Representatives of the Republic of Indonesia (DPR RI). The proposal was submitted at the Government Working Meeting with the Legislation Board, on Wednesday (24/8).

As explained by the Head of the Education Standards, Assessment, and Curriculum Agency/Kepala Badan Standar, Asesmen, dan Kurikulum Pendidikan (Ka. BSKAP), the National Education System draft law integrates and revokes three laws related to education, i.e., Law Number 20 of 2003 concerning the National Education System, Law Number 14 of 2005 concerning Teachers and Lecturers, and Law Number 12 of 2012 concerning Higher Education.

In accordance with Law Number 12 of 2011 concerning the Establishment of Legislations as amended several times, most recently by Law Number 13 of 2022 concerning the Second Amendment to Law Number 12 of 2011 concerning the Establishment of Legislations, there are five stages in the law-making process. The five stages are planning, preparation, discussion, ratification, and promulgation.

In accordance with the mandate of the applicable laws regarding the formation of laws, the government is open to receiving suggestions and input from the public. During the planning stage, the government has invited dozens of institutions and organizations to provide input on the initial draft version of the RUU of the National Education System and its academic text. The latest draft has also been sent to various stakeholders for further input. “The input from the public is a form of meaningful public involvement in accordance with the mandate of the law and will be taken into consideration in the drafting and discussion stages of the draft law,” said Anindito Aditomo.

In a Working Meeting with the legislative council of the DPR RI, the Minister of Law and Human Rights said that the National Education System draft law was expected to provide certainty to the public with an integrated reference in the regulation of the education system in Indonesia. “The basic norms of the three laws are integrated into one law, while the derivative norms will be further regulated in government regulations,” said the Minister of Law and Human Rights.
